What Is Chapter 13 Bankruptcy?
Generally, individuals who file for Chapter 13 bankruptcy (also referred to debt consolidation) are those who have a regular income flow. Chapter 13 allows the debtor to retain their property and pay all or part of their debts over a 3 to 5 year period.

The Debt Repayment Plan
The Chapter 13 process requires a debtor to file a repayment plan with the Court for approval. The repayment plan lays which creditors are being paid and how much they are being paid. The debtor is then responsible for making regular payments to the trustee.
The trustee will be responsible for collecting payments from the debtor and distributing payments to the creditors according to the terms of the repayment plan. The debtors themselves will likely have no direct contact with their creditors while under Chapter 13 protection.
Once all payments under the plan have been made, the debtor will be entitled to a discharge that, with a few exceptions, essentially releases them from all debts addressed in the plan. However, it is best to consult an experienced Chapter 13 lawyer at this stage to ensure all the requirements of the plan have been met and to navigate the discharge process.
